Pendedahan ini menerangkan struktur kontrak Syariah, tadbir urus Shariah, dan prinsip pematuhan yang terpakai kepada semua produk pembiayaan danakini.my.
This Syariah Disclosure Statement is issued by CREDIBLY IHSAN SDN. BHD. (Reg No: 202601015570 (1677667-D)), operating the platform danakini.my to inform customers about the Islamic finance principles, contract structures, and governance framework applicable to all financing products offered through danakini.my.
1. Syariah Governance
All financing products offered through danakini.my are reviewed and approved by our Syariah Advisory Committee ("SAC") prior to launch. The SAC comprises qualified Islamic finance scholars who ensure that all products, processes, and documentation comply with Syariah principles as recognised by the relevant authorities in Malaysia.
The SAC conducts periodic reviews of existing products and may issue resolutions requiring modifications to maintain ongoing Syariah compliance.
2. Contract Structures
Our financing products are structured using the following Syariah-compliant contracts:
- Tawarruq (Commodity Murabahah): Used primarily for personal and salary-based financing. The customer appoints the Company as agent to purchase commodities on their behalf, which are then sold to the customer at a deferred sale price comprising cost plus profit.
- Murabahah: Used for business financing where the Company purchases an asset and sells it to the customer at a disclosed cost-plus-profit price, payable on deferred terms.
In all cases, profit is derived from permissible trade-based transactions — not from interest (riba). The profit rate, tenure, and total sale price are disclosed upfront in the financing agreement.
3. Prohibited Elements
We are committed to avoiding the following prohibited elements in all our products:
- Riba (Interest/Usury): No interest-based lending. All returns are structured as profit from trade.
- Gharar (Excessive Uncertainty): Contract terms, profit rates, and payment schedules are clearly defined at the outset.
- Maysir (Gambling): No speculative or chance-based elements in our financing structures.
- Haram Activities: Financing is not extended for activities prohibited under Islamic law, including alcohol, gambling, and other non-halal businesses.
4. Late Payment
In the event of late payment, any compensation charged is structured in accordance with Syariah guidelines. Late payment compensation, where applicable, is calculated based on actual costs incurred and is donated to charitable causes as directed by our Syariah Advisory Committee, in line with accepted Islamic finance practice.
5. Early Settlement
Customers may settle their financing facility early. A rebate on unearned profit may be granted in accordance with the terms of the financing agreement and Syariah guidelines on ibra' (rebate).
6. Risk Disclaimer
Financing involves financial obligations. Customers should ensure they can meet repayment commitments before applying. Failure to repay may affect your credit rating and result in legal action. This disclosure does not constitute financial advice. Please read your financing agreement carefully before signing.
